FlightSim Control is a software tool for desktop flight simulation and training support. It is not an approved flight-training device, certified instructor operating station, aircraft system, flight-planning service, or substitute for approved manuals, procedures, qualified instruction, or operational judgement.
1. Agreement and eligibility
These Terms of Service (the "Terms") form a binding agreement between you and Evolve Orbit FZC, a company registered in the United Arab Emirates ("Evolve Orbit", "we", "us", or "our"). "FlightSim Control" means the website, account services, subscription, software, updates, documentation, support, and related services we provide under that name.
By visiting the website, creating an account, purchasing a subscription, downloading or activating the software, or otherwise using FlightSim Control, you accept these Terms and the Privacy Notice. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to enter into this agreement. If you use FlightSim Control for a company, school, club, operator, or other organisation, you confirm that you are authorised to bind that organisation. Mandatory rights available to consumers under applicable law are not excluded by these Terms.
2. The service
FlightSim Control provides a touch-focused instructor interface for supported versions of Microsoft Flight Simulator. Depending on the release, loaded aircraft, simulator state, installed data, connected services, and available provider interfaces, the software may assist with position, environmental conditions, loading, simulator state, exercise events, monitoring, notes, and debrief information.
Functions are capability-aware. A control shown for one simulator, aircraft, provider, or configuration may be unavailable or behave differently in another. A successful connection does not mean that every aircraft-specific function is supported. The capability state shown by the software and the release documentation form part of the product description.
We may add, change, suspend, or remove functions where reasonably necessary for security, safety, compatibility, legal compliance, provider changes, or product development. We will not describe an integration as supported unless the relevant release identifies it as such.
3. Accounts and security
You must provide accurate information and keep your email address current. You are responsible for activity performed through your account and for protecting sign-in links, browser sessions, activation codes, licence tokens, and devices. Notify us promptly if you suspect unauthorised access.
Passwordless links and activation codes are personal, time-limited credentials. Do not forward or publish them. You may approve only devices you own or are authorised to manage. We may require re-authentication, revoke compromised sessions, or refuse an activation that presents a security, fraud, or entitlement risk.
4. Software licence
While your subscription and account remain in good standing, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the FlightSim Control desktop application on the number of devices included in your plan, solely for lawful flight-simulation and training-support purposes.
The software is licensed, not sold. Evolve Orbit and its licensors retain all rights not expressly granted. Offline operation, where available, is limited to the period stated in the software or plan. The application may periodically verify subscription, device, release, and integrity status. You may replace or revoke devices through the customer portal subject to reasonable anti-abuse limits.
5. Restrictions
You must not, and must not help another person to:
- copy, resell, rent, lease, sublicense, publish, or distribute the software or access credentials;
- circumvent licensing, device limits, integrity checks, access controls, or protected downloads;
- reverse engineer, decompile, disassemble, or derive source code except where applicable law expressly permits it despite this restriction;
- modify the software to issue unsafe, deceptive, unauthorised, or unsupported simulator commands;
- probe, scan, overload, disrupt, or gain unauthorised access to our service, other accounts, or connected systems;
- use the service to infringe rights, distribute malware, facilitate unlawful conduct, or misrepresent product capability or certification;
- remove legal notices, signatures, provenance, copyright, or trade-mark information; or
- use our confidential software, interface, or documentation to create a substantially similar competing product.
Security research must follow our Security Policy. Additional acceptable-use requirements are in the Acceptable Use Policy.
6. Simulator and training use
FlightSim Control communicates with consumer or professional simulation software. It must never be connected to, used to control, or relied upon for a real aircraft or real-world operation. It does not provide navigation, weather, airworthiness, dispatch, performance, maintenance, or operational advice.
Unless we expressly agree otherwise in a signed commercial agreement, FlightSim Control is not certified or approved by any aviation authority, aircraft manufacturer, simulator manufacturer, approved training organisation, or airline. References to airline-style, instructor-station, LPC, OPC, checking, or training workflows describe interface intent and do not claim regulatory approval or training credit.
You remain responsible for the simulator, aircraft add-on, exercise design, instructor supervision, trainee briefing, suitability of failures, and recovery from unexpected behaviour. Review armed changes before execution and maintain an independent way to pause, reset, or stop the simulation.
7. Third-party integrations
FlightSim Control may interoperate with Microsoft Flight Simulator, SimConnect, aircraft add-ons, navigation databases, weather engines, hardware, and other third-party products. Those products are supplied under their own licences, terms, privacy notices, availability, and technical limitations. You must obtain and maintain all required third-party licences.
Unless expressly stated, Evolve Orbit is not affiliated with, sponsored by, endorsed by, or an agent of Microsoft, PMDG, Navigraph, Active Sky, or any other provider. Third-party names are used only to identify interoperability. We are not responsible for changes, outages, defects, data accuracy, compatibility, or discontinued interfaces controlled by others.
8. Subscriptions and payment
Prices, billing interval, taxes, included devices, and plan features are shown before checkout. Subscriptions renew automatically at the interval selected until cancelled. By subscribing, you authorise our payment processor to charge the payment method on file for recurring fees and applicable taxes.
Stripe processes payment-card information. We do not receive or store complete card numbers. You must keep billing information current. Failed, reversed, disputed, or overdue payments may result in retry attempts, restricted access, or suspension. We may change prices for a future renewal after reasonable advance notice; continued use after the effective date constitutes acceptance of the new renewal price.
Business customers are responsible for purchase orders, internal approvals, withholding, and taxes not collected at checkout. Unless the checkout states otherwise, quoted prices do not include taxes imposed by your jurisdiction.
9. Cancellation and refunds
You may cancel through the customer billing portal. Cancellation stops the next renewal and access ordinarily continues until the end of the paid billing period. Deleting the desktop application does not cancel a subscription.
Fees already charged are non-refundable and we do not provide prorated refunds or credits for unused time, except where required by applicable law or expressly stated in our Refund and Cancellation Policy. Nothing in these Terms limits a mandatory remedy for a defective or misdescribed service.
10. Updates and availability
Updates may install automatically or require action. A supported release may require a current Windows, simulator, SimConnect, driver, runtime, aircraft, or provider version. We may block obsolete or compromised releases where reasonably necessary. Backwards compatibility is not guaranteed when a third party changes its software or interface.
We aim to provide a reliable service but do not promise uninterrupted availability. Planned maintenance, emergency work, internet or cloud outages, third-party incidents, licence checks, or force-majeure events may temporarily affect access. Local simulator controls that do not require an online entitlement may continue according to the release design.
11. Support
Standard email support is included as shown in your plan. Support covers reasonable assistance with installation, account access, activation, and documented product functions. It does not include simulator instruction, aircraft procedure advice, custom integration, unsupported add-ons, on-site service, or guaranteed response or resolution times unless a separate written service agreement says otherwise.
You may be asked for diagnostic logs, versions, aircraft identity, and reproduction steps. Remove secrets and unrelated personal data before sending them. We may decline files or instructions that create a security, legal, or privacy risk.
12. Customer data and feedback
You retain ownership of information you submit. You grant us a limited right to host, process, reproduce, and transmit that information only as needed to provide, secure, support, and comply with law for the service. You confirm that you have the right to provide it.
Suggestions and product feedback may be used without restriction or compensation, provided we do not identify you publicly without permission. Personal data is handled under the Privacy Notice.
13. Intellectual property
FlightSim Control, its source and object code, interface, design, documentation, branding, protected releases, and related materials are owned by Evolve Orbit or its licensors and are protected by copyright, trade-mark, trade-secret, and other laws. No ownership transfers to you. Third-party components remain subject to their applicable notices and licences.
14. Suspension and termination
You may stop using the service and cancel renewal at any time. We may suspend or terminate access where you materially breach these Terms, create a security or legal risk, fail to pay, misuse licensing, infringe rights, or where we are required to do so by law. Where reasonable, we will give notice and an opportunity to remedy the issue.
On termination, your licence ends and you must stop using and remove the software. Terms concerning ownership, restrictions, accrued payment, disclaimers, liability, indemnity, disputes, and other provisions intended to survive will remain effective.
15. Warranties and disclaimers
To the maximum extent permitted by law, FlightSim Control is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not warrant that any command, failure, weather value, position, aircraft state, or third-party integration will be available, accurate, timely, or suitable for your exercise.
Nothing in these Terms excludes an express written warranty we give you, fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any right or liability that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by applicable law, Evolve Orbit and its directors, employees, contractors, licensors, and suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profit, revenue, opportunity, goodwill, data, or use; simulator downtime; failed training objectives; or the cost of substitute products, even if advised that such loss was possible.
Our aggregate liability arising out of or relating to FlightSim Control will not exceed the greater of the amount you paid for FlightSim Control during the twelve months immediately before the event giving rise to the claim or USD 100. This allocation of risk applies across all theories of liability. It does not apply where prohibited by law or to liabilities that cannot legally be limited.
17. Indemnity
If you use FlightSim Control for business or organisational purposes, you will indemnify and hold harmless Evolve Orbit and its personnel from third-party claims, damages, penalties, and reasonable costs arising from your unlawful use, infringement, unauthorised simulator or training deployment, customer data, or material breach of these Terms. This section does not apply to the extent a claim results from our own breach or wrongdoing.
18. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Before filing a claim, each party will make a good-faith effort for at least 30 days to resolve it through written notice and direct discussion.
Subject to mandatory consumer jurisdiction and any claim eligible for a competent small-claims process, the courts of the United Arab Emirates will have exclusive jurisdiction. Either party may seek urgent injunctive relief to protect security, confidential information, or intellectual-property rights.
19. General terms
These Terms, the documents linked from them, the plan shown at checkout, and any signed order form are the entire agreement for FlightSim Control. A signed order form controls only where it expressly overrides these Terms. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue.
You may not assign this agreement without our written consent. We may assign it as part of a merger, reorganisation, financing, sale of business or assets, or to an affiliate. Failure to enforce a provision is not a waiver. Headings are for convenience. Electronic notices and records satisfy written-notice requirements to the extent permitted by law.
We may update these Terms for legal, security, service, or commercial reasons. Material changes will apply prospectively after notice through the website, account, application, or email. If you do not accept a material change, you must stop using the service and cancel before it takes effect.
